It depends on the state you reside in as do all matters of law, some states seal juvenile records and they do not show up on a background check California is one that does not and you have to go to court to have it sealed or expunged.!~!

Will a juvenile misdemeanor and violation of probation show up on employment criminal background check?
I’m 22 now and I’m applying for a job, they asked if I had ever been convicted of felony OR misdemeanor and I do have a misdemeanor on my record that I was given probation for, which I violated once. I forgot to mention the violation of probation, are they going to find that on my record? I was under 18 throughout the whole thing.
BTW I’m in Florida and the arrest and probation also were in Florida.

Can you be forced?
No.
Can they ask you to?
Absolutely.
If you say no, what can they do?
Not all that simple, but still simple enough, and pretty unhappy for you either way. Perhaps you’ll be entitled to justify your refusal. Probably not. Most employees in Ontario – depending slightly on industry – don’t actually have privacy protection as against the employer. So there’s no privacy legislation or other such thing that you can rely on to refuse. Depending on the reasonableness of the request, it may well be insubordination to refuse, and ultimately constitute just cause for the termination of your employment.
If it doesn’t constitute just cause, then they’d be obliged to provide you with notice of termination in accordance (or pay in lieu thereof) with either your contract – subject to the ESA minimums – or alternatively (if your contract is silent or otherwise unenforceable on the point) on the basis of “reasonable notice” at common law. Length of service is an important factor for calculating notice, and since you say “after being hired”, I’m going to go out on a limb and suspect that you’re a new hire. Meaning very little length of service. Meaning a short notice period, and a recovery at the end of the day likely to be dramatically exceeded by your legal fees for getting there.

Standard background checks are 10 years prior.
Background checks for high-security positions run 15-20 years prior.
I run them everyday.

Assuming he petitioned the courts and had his juvenile records sealed, then they can only go back as far as 18. If your friend didn’t have his juvenile records sealed, then they will be able to see those too.

AT&T will call to verify employment, not so much ask their opinion about your work ethic. They will run a background check to make sure you don’t have any criminal offenses, and there is sometimes a drug test. Other than that, it is not like the FBI or CIA. If you made it to the background check, than you are in a good position to get the job.
