An employer can conduct a new background check or drug test on you pretty much whenever they want, as long as you consent. (It’s a bad sign if you don’t consent

Are there any legitimate companies, which perform criminal background checks on prospective employees?
I want to hire someone to clean my mother’s house, without worrying that they have a criminal background. There are hundreds (if not thousands) of web-based services that supposedly do this, but it appears most of them are scams. I know that large companies can have background checks done on prospective employees. Who do they use? Are there any HR professionals out there, who can give me some suggestions? Thanks in advance!

Usually it is the smaller companies that don’t run criminal background checks. But for a misdemeanor, it shouldn’t matter. If the employer is that worried, it would be best to say “Will discuss in interview” on the application. Then go to your local One Stop or the LMI (Labor Market Information) website and get a WOTC form (Work Opportunity Tax Credit) for the employer so they can get a $1200-2400 tax credit for hiring you. Good luck!!

The only way that I know to get a 50 state criminal record check is to run a FBI check and then look at the individual states that show criminal records. Some states allow criminal history checks online. In Michigan it is called ichat and it can be located at the State of Michigan website

For any software to do the job you said it requires the existence of very large database of information about persons with criminal background. It is very cumbersome task to collect and update this information and so only government law enforcing agencies such as police and judiciaries can afford it. If these government authorities allow access to this information then the software can be developed which will search the database to ensure that the prospective employee does not have any criminal background. In case that person has any criminal back ground then it will furnish all the details. The main problem is permission to access the government database.

What companies don’t do criminal background checks on potential employees?
I have a pending misdemeanor allegation and am going through a bunch of job interviews. They love me, but when they run the check the pending litigation comes through and they won’t hire me. I need to find a company that does not do criminal background checks.
