    I work for a reputable background check company and have done so for over 8 years.

    That being said, we never report dismissed cases as it’s not ethical to do so and virtually all of the employers I work with don’t take dismissed cases into effect.

    Honesty is always the best policy and employers don’t like to be suprised, but I see nothing that should harm you in any way. Should adverse action be taken, contact your attorney right away (or as soon as he gets back from vacation). :)

    Expunging Your Criminal Record
    Calling all Attorneys!
    In California I have 2 items I would like to have expunged from my record which show up when I apply for a job and they run my finger prints.
    #1 Petty Theft from 1988 (shoplifting, couple rolls of 35mm camera film) convicted, time served, 1 day in county jail then released. I was 18 years old then now 39 yrs. old).

    #2 In 1991, originally charged for a DUI, I retained the services of a lawyer and was reduced to Exhibition of Speed, got 3 years of probation, cleared with no problems.
    Brief case description: I was returning from a birthday happy hour party with a couple of brinks in me (not drunk or anything like that) and was driving on freeway with friend following me and she got into a car accident a few feet behind me, I then stopped to help out, no injuries, but her car was totaled. I then waited for her to clear-up situation with CHP and then a CHP Officer approached me and did a sobriety test and noticed I had been drinking, he then took me to the local jail and they kept me their till the next morning and let me go.

    How difficult and what are pro possibilities of getting these 2 items expunged? Since the last item, I have not had anymore problems with the police, besides a couple of speeding tickets several years apart, but I guess those don’t count because they don’t appear on your criminal record, only on your driving record if you don’t go to traffic school, which I did do.

    I plan to retain the services of an attorney to have these 2 items possibly removed.

    Any comments, suggestions or advised will be greatly appreciated.

    Yes, all fees/fines were paid and probation of 3 year expired which initiated back in 1988 and the other back in 1991.

    pretty good.I review apps/res etc weekly,Yours has just enough info that would make me read it,so many people put so much,I don’t even read them…..
    1-phone nbrs…..home…..include a cell….
    also never let a call from a prospective employer go to voice mail…
    2-add your email address,many people,me included,paste resumes into files and respond to potential employee via email….
    3-personalize your first sentence to the specific company and specific position….find out what that company calls that position…..it will make you feel like you are one of them;;;;

    I am a California defense attorney, formally a prosecutor for 19 years. The fact is these should be easy to expunge under penal code 1203.4. Contact an attorney and get it done. This presumes you have paid all the fines and fees and the summery probation has expired.

    Criminal Background Check results will this affect getting a teaching job?
    I am in college and had to get a background check so that I can start student teaching. My identity was stolen 2 years ago and during that time someone got a credit card in my name and then used one of those “convience checks” that the credit card company sent to purchase something and the check bounced. The store that acceptted the check then had the local courts charge me with a simple worthless check misdemeanor because it was my name and social that opened the account. The case was dismissed before trial because the wrong person was charged. However it should up on my criminal record. This is the first time I have had to do something like this so I am not sure if the description from the background checkcompany would clear me from questioning from the teaching boards or not. See what you think. I pasted the description from the report below. There was no trial, arrests, warrants, fines, jail time, etc. The magistrated simply disposed the case based on the evidence that my attorney (who is currently away for a few weeks) provided about my identity theft and police reports, handwriting samples, etc.
