Finding A Criminal Defense Attorney

The court system alone can be quite confusing to anyone that does not have the knowledge or expertise to maneuver around within it. When you find yourself on the defensive end of the spectrum within this system, it is almost always better for you to hire a defense attorney instead of trying to defend yourself. A criminal defense attorney's main job is to defend you in court to the best of their abilities. They know the ins and outs of the system and will be able to provide you with the best chance towards the outcome you are looking to achieve. Some will have stronger defense abilities in a particular crime while others may have better abilities in another crime. Therefore, hiring the right defense attorney can be quite crucial.

First, ask around to find out about any lawyers around your area with a good reputation. You can ask family, friends or others you may know who have been through a similar situation. You can also look through the phone book in the yellow pages where you will find there are many attorneys listed. Most of them will highlight their areas of expertise in an advertisement within the yellow pages as well. It may be best to look for a lawyer specializing in your type of case.

Once you contact a criminal lawyer they will want to first meet with you on a consultation basis which is of no charge. This helps them decide if your case is one they are willing to take on as well as determine their fees and potential costs. The costs can vary greatly and will have a lot to do with the amount of work involved in your particular case, as well as their own level of expertise. If you feel their fees are too high then try and negotiate with them. You can often times negotiate a lower price or set up a payment plan with the defense attorney.

Fees may not be the only concern you have with the attorney. You will want to find out if they have handled cases similar to yours and how many. You can also gain their thoughts on how long they feel your case may continue until resolved. Ask and find out if they are going to be the only one working your case and how often they will be in contact with you. You will want to have regular updates on their progress.

Once you have your questions answered and if you choose to hire the criminal lawyer, you will need to sign an agreement or contract on their services and costs. Along with this, the defense attorney will expect a retainer fee from you. This secures their services for you, and once paid, they will begin to work on your case. Having a well-qualified criminal defense attorney on your side will help you as you make your way through the sometimes confusing legal system. Be sure to do thorough research before making your final decision.

    Ideally, it would be nice to have an attorney from the moment you get arrested. While this is may not be practical, it would benefit you to speak to an attorney as soon as possible after being released from the holding cell after your arrest. If facing a more serious crime, an attorney should be hired immediately.

    How does attorney fees work for non criminal matters?
    I asked this question in a different way, and I neglected to explain that it’s not a law suit case, so ‘contingency’ is probably not an option.
    My question is: If a potential client doesn’t have the entire retainers fee up front for an attorney, is there a way that an attorney can start representing the client with some sort of a guarantee that he/she will be paid? Is there a form of written agreement that can be drawn up between the attorney and the potential client?

    What happens if you don’t pay attorney fees after the attorney assists you with a case?
    A friend of mine was involved with a criminal trespass case in which he visited an attorney for advise. At no time did he advise this attorney that he wanted his representation. When his court date came, the attorney was there and assisted with the case. There was no contract signed or anything of that nature. This happend in 2003. Bills are still being sent to his house from his attorney, but he has not paid anything.

    A felony carries with it the possibility of jail time, so you are entitled to an attorney at no cost to you (Public Defender) in each and every jurisdiction in the United States under the 6th Amendment to the Constitution.

    If you do not want to go with the Public Defender, there are other organizations (Legal Aid, for example) in many communities that may assist you with this matter.

    What should I look for when trying to retain a criminal defense attorney?
    I am looking for a lawyer to represent my mentally ill adult brother on a drug charge. I have no idea what I should be asking the attorneys I call (other than their fees) since I never dreamed I would need an criminal attorney. Can anyone advise, please?

    Are there any organizations to help with attorney fees in a criminal feleny case?
    I got a check it was varified by the bank. it came back as couterfit.I am charged eith forgery and burglerlty

    An attorney is free to draw up a contract that allows for a certain amount down and certain amounts to be paid at various intervals. Some attorneys will do this with certain types of matters.

    It is virtually never done in bankruptcy cases and it is reluctantly done in cases involving the courts as there is no guarantee that the attorney will be allowed to exit the case should the client not pay.

    The money is owed because the attorney provided the services. The attorney could sue your friend and get a judgment against him. Depending on the collection laws of the state in which he lives, your friend could have his wages garnished, his motorcycle or car, guns, boat, sporting equipment, or furniture seized pursuant to a Writ of Execution and sold at public auction. Yes, judgments can also be executed upon against any real estate the friend owns (subject to existing mortgages and any “homestead exemptions” which the state in which he lives allows). Or, the attorney could just leave the civil judgment on record to damage your friend’s credit rating.
