It does not matter if you are the driver, passenger, or a pedestrian. If you were involved in a road accident, you should consult with a solicitor if you want to claim compensation for your injuries - from whiplash, broken limbs, back, neck injuries to the far more serious head injuries and other serious injuries.

At the onset, if you were in a hit and run situation, where the driver ran off after hitting you and breaking your bones, you need to make a claim first with the Motor Insurers Bureau (MIB) for an untraced driver claim. The MIB also has a compensation program for people who were injured by uninsured motorists. In the case of an uninsured driver, you need to file an uninsured driver claim.

In general, if you signed for the legal insurance option on your car's insurance coverage, then you would already have a solicitor when you want to file a claim. Legal insurance options generally cost from between GBP 40 to GBP 90. If you did not opt for legal insurance, do not fret however. Most law firms would be happy to represent you without asking for any legal fees upfront. Remember though to ask about the fees both in a "won" and "lost" situation. Although many law firms brandish "no-win, no-fee" slogans, they tend to forget to mention the fees they charge if you do win a claim. Remember also that there are some that guarantee 100% of your compensation, but do not like to represent the riskier claims.

If you meet a traffic accident, make sure to receive professional medical attention so that your injuries are documented and therefore can be proven. In the United Kingdom, claims for car accidents often fail because the claimant did not rush to a hospital to discuss any pain arising from his injury. Medical notes are the single most important documentation for an accident claim. Apart from proving that you indeed met an accident, the notes will also go to establishing what amount should be awarded to the claimant. Thankfully, in many cases, ambulances are always called on to the scene of accidents, especially when the police are already involved.

In recent years, the number of people claiming for injuries arising from road traffic accidents has increased dramatically. Many are led to believe that the increase in compensation payouts for accidents is causing the sharp rise in insurance premiums. However, this is not entirely correct since the average payouts by insurance companies to claimants are just between GBP 1,500 to GBP 2,000. The amounts cannot even pay for the total of actual damages to the cars involved in the car crashes.

Under the law, all types of vehicles must be insured. Anyone is entitled to make a claim provided they were proven to have been involved in a vehicular accident, and that someone else is responsible for it. You can make a personal injury claim even if the driver that caused the accident is not insured or if the driver conveniently ran away after the accident.

    Hello,

    The MIB do accept claims for accidental damage to vehicles/property as well as injuries. You only have 9 months from the date of the accident to claim for property damage. Go onto their website and make your claim as soon as possible, you will need to complete and submit a claim form under the Untraced Driver Agreement. I work as a claim/fraud investigator.

    Hit and Run compensation?
    My husband got knocked off his bike yesterday evening. The van who hit him did it deliberately, then sped off. The police are looking for the van but it is unlikely they will find him.

    Has anyone ever claimed from the Motor Insurance Bureau? My husband’s injuries are not severe, only cuts and bruises and a torn calf muscle. However his bike (brand new Boardman Carbon racing bike) will need a new saddle, front wheel, pedal, handlebar tape and he will need a new helmet and possibly cycling shorts. Also the levers and paintwork are scuffed although they still work.

    If this were a motorbike I would replace all the damaged parts so that it was like new. Which is only fair if someone else damaged your car or bike. I know that if you’re hit by an uninsured driver or an untraceable driver you can claim from the MIB for compensation.

    What I don’t know is whether they only pay out for injuries, or whether they would not pay out for trivial things like handlebar tape or a torn bike saddle? At the end of the day to put his bike back to new will cost us about £500.

    Does anyone have any experience about claiming for a hit and run?

    Can I claim compensation or take legal action for erroneously reporting my accounts to Credit Bureaus?
    Hi,

    I was surprised to get letters from a few credit card companies saying that my credit limits have been reduced to almost nothing due to some adverse accounts reported to credit bureaus. When I looked at the report I was shocked to see 3 accounts wrongly reported and for no fault of mine. In the case 2 credit card accounts, I never used them in the first place and they had deleted them from their system long ago. In the case of the other account, I never defaulted on my payments till date and they goofed up internally to account for my payments due to some software issues as confirmed by their employee. So, in all these cases I am not at fault and I have recently faxed them the details about these and waiting for responses.

    Now that I have been punished for no fault of mine and made to suffer mentally and financially, I am thinking of taking some action on those companies.

    I need an answer if I stand any chance of lodging a claim for compensation for the sufferings I am going through or some sort of legal action.

    How to take legal action again online money transfer service?
    I had used an online money transfer service to send money to another country. This company is registered with Better Business Bureau (BBB). Its been more than 4 weeks and I could not get any proper communication and finally they refunded the same amount without sending the money telling me a sorry. Now I’m going to register a complain with BBB. But apart from that can I legally register a complain to get any form of compensation. I don’t think BBB will get any compensation from them. I would assume if the company addresses and close the issue. Now that my money is back to me, BBB could say..well..the problem is solved as the money is refunded. But i have gone through so much pains, wasting several hours in phone, international calling cards to call the recipient and the recipient wasting lots of money in transportation, international call etc..So I would want to legally claim compensation and take action. So can somebody lead to the right way of how I could do this. Thanks

    Your only recourse would be against the creditors themselves since the bureaus only report what is sent to them by the creditors.

    Could I be prosecuted in the UK for driving without insurance abroad?
    Last year I was hit by a speeding driver in Italy whilst driving my husbands car. The driver of the other vehicle immediately ran off even though myself, my husband & our 1yr old daughter were injured. At the time of the accident we had been in Italy for about 5 months & although I had all the relevant documents to drive within the UK, my insurance only covered me for 30 days abroad. We returned home shortly after so I could receive further treatment and I ignored requests from the Italian police to forward on my insurance details as I now knew we were not covered. Today I have received a letter from the Motor Insurers Bureau saying they have been contacted regarding the matter & could I please get in touch (via a solicitor if required) with my insurance details. I am now really worried that as well as being badly scared & not able to make a claim for compensation, I could also be prosecuted in the UK (or my husband as it was his vehicle). Does anyone know where I stand?

    Short answer, yes.

    You have committed a driving offence within the European Union. All driving offences committed within the E.U. are referred to your home country and legal action can be taken.
