Wife got into car accident and police issued no ticket! Injury! Car totaled! Insurance battle? Attorney?
My wife was involved in a car accident.
The accident happened at a four way stop sign intersection.
My wife was traveling Eastbound.
The other driver was traveling Southbound.
Long story short, they both got to the intersection at the same time and my wife had right of way being on the right. The other person either didn’t yield to right of way or ran the stop sign. It happened real fast.
My wife was hurt and went to the hospital directly from the accident scene and wasn’t able to talk to the police officer before leaving the scene. The other person lied and told the officer that my wife didn’t stop so when the officer came to the hospital he was expecting to give my wife a ticket for not stopping until she straitened him out on what happened. Now he says he won’t issue any tickets because he is unable to make a determination about what happened. That is him basically saying he f’ed up.
The people who hit her already called my insurance agent and yelled at him, blaming my wife 100 percent for the accident.
There were no witnesses other than the two cars involved.
So here we are with a totaled car, injured wife, insurance battle, and no ticked issued.
How do you think things will pan out and where do we go from here?
I spoke to a lawyer who suggested we pay 5-10,000 for an accident reconstruction and that he won’t get paid unless we get any money. But if we lose we are out the$5-10,000.
Now what money does he think we will get? Pain and suffering? Missing work? Daycare?
Our car had full coverage which is only worth $6000 or so and my wife had a $40,000? dollar surgery to fix her arm which the PIP on the vehicle will pay $4500 out immediately and her health insurance(which is really good) will take care of the rest.
I have heard of people who fought in court and won, and basically any extra money they won went to the lawyer. I don’t want to enter contract with him if he is just leading me on for his own benefit.
I am not in a financial position to pay out of pocket for the accident reconstruction and I am afraid if I go the legal route I won’t end up any better off and perhaps worse than we are now.
Would I have any avenue in which to challenge the officers’ decision not to issue a ticket? Can I go over his head? Can they go back and issue a ticket days later?
Has anybody else been here and what happened? I am at a complete loss on which direction to proceed at this point.

IIf a vehicle is involved in an accident, and the insurance company has not settled the claim yet, and the person claiming injuries files a lawsuit against the vehicle owner, can the plaintiff place a lis pendens on the home of the vehicle owner?

Car Accident No obvious physical injuries….. Should I speak to Accident Attorney?
I was in 3 cars accident a week ago. A lady rear ended me and hit my car. I only felt one impact from the accident. The third car just hit the car behind me.
I bought my car 2 months ago from dealer as brand new. The rear bumper of my car is scratched and no other damage. I can feel some small pain on my back since the accident.
I think I deserve to receive more benefits since my car still pretty new.
Should I get a attorney for the insurance claim? Please advise.

I’m an insurance rep in CA… The claimant (person you hit) can not file a suit against you if you have enough liability coverage under your auto policy. As long as you we’re insured during the accident, you’re insurance company should handle the claim in full. Contact your adjuster and let them know what’s going on. They should be able to handle it from there… as long as you have enough coverage!

You can speak to an attorney…. but that is all you will do is speak to him. No attorney will take a case like this as there is no money in it for you or them.

The officer did not “f” up. He went to the accident scene….the other driver told him. I stopped at the stop sign first….then she got to it and did not stop. He then speaks to your wife who says …”no, I stopped at the stop sign and he failed to yield right of way”. So…the cop has two differing stories….no witnesses and no way to break the tie.
Yes, you can pay 10K for an accident reconstruction. But, even that’s not going to be able to tell you who got to the stop sign first. The reconstruction can tell you how fast each car was going at impact. But, from what you say, speed is not an issue here.
For about 2K-6K, you can hire an engineer to harvest the data from your air bag control module and convert that data to a usable form. If the event was bad enough to be captured by the air bag control module…depending on the type of car you have, it may give you information on the speed of your wifes car, if she applied the break, when, what pressure. But that’s still not going to tell you who got to the stop sign first.
Now…if the 4 way stop is at an intersection that would have a business with a security camera – you can go speak to the manager of the business and see if their security camera may have caught the accident in the back ground. It’s a long shot but worth a try.
Now…. you can push it with the officer….and maybe he’ll ticket both drivers. It’s word vs word. There is no witness to break the tie. The officer has no way to know which version is correct.
Of course a lawyer is just leading you on for his own benefit. He has a big house, nice cars and childrens educations to pay for. Plaintiff lawyers don’t work for free or for a sense of justice. They work for the same reason every one else does….to pay their bills. In general, a lawyer’s fee is 33% + expenses of any settlement you get.
Now, if you have collision coverage – let your company pay for the damage to your car. If they think they can win, they can file for arbitration and try to get paid back. Since it’s word vs word, they may not win in arbitration but they can try.
It depends on state law how this will be handled. In some states, a word vs word is handled 50-50. (your company would pay 50% of the other drivers claim….his company pays 50% of yours). In others, word vs word is handled as your company pays for your car….his company pays for his car and neither company pays anything for the other. Or your company could just back their driver and deny the other’s claim.
No one here can tell you what will happen.
Your best bet is to turn in the claim to your company and speak with your adjuster. He/She will be in the best position to tell you about what could happen. But even he/she can’t tell you 100%.
